Duties and Responsibilities
Assist farmers in succession planning in order to help preserve farms for future generations.
* Advising on the setting up of companies, partnerships and limited liability partnerships.
* Provide guidance in regulatory compliance.
* Understand environmental legislation vs. landowner rights.
Completing land transactions, including sales & purchases, option agreements and easements.
Advise on Farm Business Tenancies and Agricultural Holding Act Tenancies.
Advise on common land rights.
* Give general legal advice to individuals, companies or organisations.
* Identify and carry out opportunities to help protect farms from adverse possession or right of way claims.
* Develop a detailed knowledge of issues affecting agriculture.
Understand unregistered land titles and how to apply to register them.
* Build relationships with local farmers and farming contractors.
* Work collaboratively with peers and external organisations.
General
* Any ad hoc and ancillary matter relating to agricultural property.
* Raising appropriate enquiries and considering documentation.
* Drafting correspondence and documentation.
* Dealing with agents, solicitors, clients and other individuals in the transaction.
* Ensuring the transaction runs as smoothly and quickly as appropriate for the situation.
* Legal research where required.
