Overview

Right to Work Compliance Officer

Department: Human Resources
Band 4 £27,485 - £30,162 Per annum pro rata
Hours: 30 per week, all MKUH roles will be considered for flexible working

Are you ready for your next step where you can make a difference? If you have experience in HR, immigration compliance, or workforce administration, we would love to hear from you. We are seeking a proactive and detail-oriented Right to Work Officer to join our Workforce Information team. The postholder will have advanced Excel skills with the ability to manipulate data to support compliance and reporting requirements.

In this role, you will ensure MKUH remains fully compliant with UK Visas and Immigration (UKVI) regulations and legislation as well as managing and maintaining our records to safeguard our sponsor licence and support a diverse, legally compliant workforce.

Responsibilities

* Conduct and record right to work checks in line with Home Office and NHS guidelines.
* Support with the administration of visa sponsorships, including issuing Certificates of Sponsorship (CoS) for re-sponsorships of existing employees.
* Provide training and guidance to managers of employees with temporary right to work in the UK.
* Prepare reports for audits and ensure timely reporting to the Home Office.
* Monitor changes in immigration law and support the updating of policies.
* Maintain accurate and up-to-date records in ESR (NHS – HR System) and Case Tracker systems and provide reports as directed by Workforce Information Manager.
* Communicate with employees and managers on right to work matters, offering advice and support in line with Trust policy and UKVI regulations.
* Develop and maintain an excellent understanding of right to work processes and procedures both legislative and locally at MKUH.
* Proactively conduct and record right to work checks in accordance with Home Office and NHS guidelines and Trust policy.
* Escalate issues where an employee cannot evidence their right to work in the UK to the Employee Relations team in a timely manner for resolution.
* Accurately record and maintain confidential information relating to right to work in the UK for employees on ESR, including visa status, share codes, PVNs and right to work expiry dates.
* Support the administration of Skilled Worker or other visa sponsorships, including issuing CoS for existing employees.
* Liaise with employees requiring visa extensions and process through the UKVI software system in a timely manner.
* Support with the administration of CoS (Tier 2) within the Trust, carrying out positive verification checks where required and ensuring timely renewals.
* Coordinate and run regular (monthly) reports from ESR to support timely right to work checks for all visa types; plan checks and notify employees of impending expiries to ensure timely CoS issuance.
* Record all right to work expiry dates on Case Tracker and monitor progress with reverification of right to work.
* Ensure timely and accurate reporting to the Home Office via the Sponsorship Management System in line with sponsor licence duties, including changes in employment status, absences, and other reportable events.
* Record accurate and up-to-date right to work information, develop improvements, and escalate issues to the Workforce Information Manager with recommendations for changes as appropriate.
* Provide guidance and information to managers of employees on visa, reminding them of responsibilities.
* Provide regular reports to the Assistant Director of HR to audit compliance of timely and accurate right to work data.
* Assist with internal audits and external inspections related to right to work and visa reporting compliance.
* Provide other administrative support as required and keep up to date with changes in immigration law, UKVI regulations and NHS policy, sharing updates with the wider HR team.
* Assist the Workforce team by accurately inputting data and generating HR reports as directed.

Requirements

* Experience in HR, immigration compliance, or workforce administration.
* Advanced Excel skills and the ability to manipulate data to support compliance and reporting requirements.
* Ability to work in a proactive, detail-oriented manner and to manage and maintain confidential records.
* Strong understanding of UKVI regulations and NHS policy related to right to work checks and sponsorship.
