Role Summary:
This role will manage the commercial life cycle on associated support contracts from inception through to completion, ensuring stakeholders are engaged, progress including schedule, cost and risk is reported on robustly and change is managed effectively.
Function:
The Commercial function provides commercial and procurement capability across the programme lifecycle, including strategy (setting the commercial strategy and advising risk allocation underpinning the delivery strategy), delivering procurement activities for the goods and services required to deliver the asset and run EWR Co, and delivering contract management services for the complex network of suppliers supporting EWR Co. Across all three of these domains the commercial function will run governance and reporting to measure compliance and provide commercial assurance.
Key Responsibilities:
* Engage with internal stakeholders to build close trusted relationships and to ensure a full understanding of expected outcomes
* Develop a contract management plan setting out all processes for managing the contract and discharging EWR obligations.
* Monitor, manage and report on all commercial aspects of allocated projects, flagging issues and proposing mitigation actions
* Review supplier/contractor delivery; attending all progress meetings to actively influence supplier/contractor’s commercial behaviours, delivery and activity.
* Undertake all contract administration activity, including developing and managing variations/ change controls and other contract mechanisms.
* Manage the pay and performance mechanisms, including validation of contractor performance (e.g. KPIs) and verification and payment applications in line with contractual terms and conditions, challenging cost elements where appropriate.
* Provide pro-active advice and guidance to stakeholders, producing all required documentation for approval in accordance with levels of delegated authority
* Produce applications for payment/invoices to outside clients in accordance with relevant funding agreements, including supporting documentation as appropriate
* Identify and advise on all commercial risk/claim events.
* Analysis and resolution of contractual issues – making effective decisions, mitigation risk and driving continuous improvement.
* Produce appropriate commercial correspondence and contractual notices for issue in accordance with contractual conditions. Commercial records should be retained and archived properly upon close out.
* Undertake final account settlements and internal reconciliation to enable project close-out as and within agreed timescales.
* Support with pre and post contract procurement activities as appropriate.
* Check whether all contractual specifications are effectively implemented and thereafter monitored to prevent any potential non-compliance, delay, or lack of organisational cover etc. which could introduce the importation of risks to the programme/project manager’s portfolio.
* Ensure EWR contract systems and reporting is up to date including the reporting of risk in line with EWR risk management processes.
* Take responsibility of your own and others’ health and safety by adopting and working to the EWR Co Health and Safety principles.
* Demonstrates a cost-conscious mindset, keeping tax payers’ money at the forefront of decisions.
* Shows a commitment to innovation by proactively seeking creative solutions to challenges and opportunities.
* Act as a role model for EWR Co’s vision and behaviours, working in ways that are aligned with EWR Co’s Ways of Working, as well as encouraging and supporting others to do so too.
Skills, Knowledge and Expertise:
* Experience managing NEC4 ECC contracts (Essential)
* Relevant railway and/or construction experience
* Knowledge of railway and construction commercial contract management and estimating.
* Good interpersonal and communication skills.
* Experience of the management and review of supplier/contractor’s interim and final accounts.
* Broad experience of working in a complex, safety focused and regulated organisation with multiple complex interfaces, and delivering to time budget and quality (desirable).
