Purpose
Principally, to procure and manage:
1. Provision of strategic Technical Due Diligence guidance (for all acquisitions and disposals).
2. Strategic development monitoring services for forward funded developments using external “best in class” suppliers and supporting consultant teams
3. Reviewing the maintenance and adequacy of live sites ensuring planned preventative maintenance and operator obligations are fulfilled and highlighting any defects or improvements for review.
4. Provision of supporting contractual engagement documentation and commercial review.
5. Construction litigation management
The role will specifically support the M&G RE Living Team as part of the overall service provision provided by M&G RE Construction.
To oversee the full range of development, building and construction services, procured externally, in a cost-efficient and commercially expedient manner, with the objective of maximising investment returns, whilst evaluating, managing & mitigating risk.
To provide support, strategic guidance and technical advice to Fund Managers, Origination, Asset Managers and other stakeholder groups for both existing assets acquisitions and developments.
Key responsibilities
Oversee Technical delivery
Deliver project coordination, design, construction delivery, quality assessment, technical guidance, analysis and commercial interpretation, to support decision making by M&G RE's Origination & Asset Manager Deal Owners; manage the selection, appointment and strategic overview of relevant specialist consultants; provide support, analysis and assist decision-making on reports produced by external consultants.
Living Acquisitions & Disposals Technical Due Diligence
Strategic selection, appointment and strategic guidance of both Framework suppliers and ad-hoc specialist consultants; providing technical guidance, analysis and commercial interpretation of reporting to assist decision-making for transactional activities.
Living Development Monitoring/ Delivery
Provide the duties of the “Fund Surveyor” in relation to development loan/ funding agreements for Fund capital transactions; review of construction and project related appointments and contractual terms to be agreed with Developers. Manage the procurement, selection, appointment and overview of both framework and ad-hoc consultants to undertake:
6. Development Technical Due Diligence of Developer’s design stage(s) information and identifying outstanding works packages
7. Rights of Light & Neighbourly matters
8. ESG related appraisal and compliance activities
9. Environmental Review/ monitoring
10. Development, Finance, Construction monitoring
11. Reinstatement Cost Assessment
Provide funder technical representation at key stage project events i.e. Sectional / Practical Completion / discharging of agreement conditions utilising M&G RE Gateway Approval Stages. Own development delivery, challenge and interrogate all delivery partners and scenarios, in decision making and driving best quality and value in development delivery of turnkey development.
Living Estate Strategic Management
Collaborate and integrate with M&G RE’s Living Team, as part of M&G RE Construction, to improve, develop and implement property strategies. As part of the overall estate management (delivered in-house and via 3rd party suppliers):
12. Monitor post development delivery and implement design changes to specifications and activities of next generation developments identifying risks and opportunities; Provide technical advice and recommendations for maintenance, repairs, and upgrades.
13. Maintain up-to-date knowledge of Building Regulations, Building Safety Act, industry standards, and best practices.
14. Lead in post construction: construction defect resolution, disputes. litigation and Incident management supporting the Living asset management team.
Living Framework Agreements & Construction Suppliers
Provide technical and contractual input in the use of M&G RE's Framework Supplier Agreements including:
15. the correct use and standard amendment of framework and appointment documents and construction contracts;
16. the management of projects procured through the Frameworks and those requiring other technical support;
Environmental Social and Governance (“ESG”)
To understand, contribute to and champion M&G RE’s ESG strategy and objectives as relevant for development and construction activities; provide guidance and advice to Deal Owners and those external partners and suppliers engaged to deliver ESG initiatives.
Safety & Security
With M&G RE’s H&S Team, assist in provision of technical, contractual and commercial advice through M&G RE's Frameworks and ad-hoc appointments to deliver M&G RE's Safety, Security and Fire Policy objectives.
General Responsibilities
To engage and collaborate with M&G RE's Fund Managers, Origination & Asset Manager Deal Owners, and those colleagues across the wider business, including external partners and suppliers as appropriate, to deliver a seamless and “best in class” service to enhance outcomes. To understand and demonstrate positive behaviours in line with our Attributes and Expectations.
To maintain professional competence through CPD and training activities.
To fulfil regulatory requirements, maintaining a strong discipline to ensure compliance with:
17. AML (anti-money laundering) and TCF policies (Treating Customers Fairly).
18. All regulations, investment guidelines and restrictions regarding clients’ mandates.
19. M&G RE’s governance, policies and procedures in addition to any that may be client specific.
20. Fulfilling regulatory requirements, including timely completion of all regulatory training and declarations and timely reporting of breaches or policy or compliance regulations.
21. Health and Safety responsibilities appropriate for the role.
Requirements and Experience
Critical experience
22. RICS qualified 10yrs+ (or of equal professional qualification), from a Living focussed technical, Building Surveying or project background, with a demonstrable track record working as part of a team with minimal supervision and with suitable post qualification experience suitable for a role requiring strategic guidance of development and construction.
23. Demonstrable “Client Side” experience in a similar strategic role specifically from BTR/ PBSA/ Senior Living background, in the technical delivery and post completion management of development.
24. Strong technical, contractual and project exposure, with experience of dealing with all types of stakeholders.
25. An understanding of complex property transactions, working with legal representatives, Developers and other senior consultants.
26. Competence in managing construction related disputes and negotiation skills including technical competence.
27. Strong ability to develop and deliver strategic processes and associated documents.
