Elite Personnel is delighted to be recruiting on behalf of a well-regarded and growing law firm seeking an experienced and committed Solicitor in their Court of Protection department to join their specialist team. This is an excellent opportunity to work within a highly specialised and rewarding area of law, representing vulnerable adults and their families in complex and sensitive matters. The successful candidate will join a supportive and collaborative team handling high-quality, meaningful work.
The Role
You will manage a varied caseload of Health & Welfare Court of Protection matters, including:
* Applications and proceedings relating to capacity and best interests
* Residence, care and contact disputes
* Applications brought under legislation
Key Responsibilities
* Managing a caseload of Health & Welfare Court of Protection matters
* Drafting applications, statements and other court documentation
* Instructing counsel where appropriate
* Advocacy and attendance at Court of Protection hearings (where appropriate)
* Advising clients, family members, professionals and deputies on capacity and best interests issues
* Working closely with the Official Solicitor, local authorities, medical professionals and care providers
* Ensuring compliance with the legislation and relevant case law
* Supervising junior team members where appropriate
About You
* Qualified Solicitor in England & Wales
* Demonstrable experience in Court of Protection Health & Welfare work
* Strong knowledge of the Mental Capacity Act 2005, Care Act 2014 and associated case law
* Knowledge of Civil Legal Aid (desirable)
* Excellent drafting, communication and advocacy skills
* Compassionate, client-focused approach with the ability to manage sensitive matters
* Strong attention to detail
* Ability to work independently while contributing positively to a collaborative team
