City & Capital are currently representing a rapidly growing & highly respected real estate finance lending group who have retained our services to appoint a specialist In-House Lawyer to their market leading legal team.
The arriving Lawyer will demonstrate a minimum of 2 years PQE and will have a demonstrable background in collections, debt recovery & litigation - ideally within the secured lending or real estate finance sectors.
Our client is renowned for supporting property developers with access to key funds for projects, offering solutions such as bridging finance, buy to let loans, development exit loans and commercial mortgages.
As our client has doubled the size of their loan book 6 times in the last 6 years they are experiencing record levels of debt quantum, loans and borrowers on their books. With large & exciting lending plans over the coming years, this is set to continue to swell, making this a pivotal appointment, at an exciting time.
Reporting to the Head of Legal you will be the legals team's resident expert in respect to collections, debt recovery & litigation and will support the development of strategies and activities that supports objectives, ensuring the business remains commercial, and protected.
Key Responsibilities:
· Take the lead role in terms of enforcement strategies and activities in the event of default
· Liaise with external legal counsel, receivers, administrators, asset managers, and other stakeholders at all stages of pre-enforcement and enforcement processes
· Draft assignment documentation, demand letters, reservation of rights letters, amendment letters, consent letters, and extension letters
· Review legal documentation associated with debt recovery, including fixed charge receiverships, administrator appointments, bankruptcies, settlements, and property-related litigation
· Advise on and handle insolvency-related matters, including guarantee enforcement, bankruptcies, and corporate insolvency.
· Support the wider legal and credit risk teams on ad hoc queries relating to insolvency matters
· Maintain detailed records and reporting for ongoing recoveries cases
· Ensure legal risk associated with recoveries activity is effectively identified and mitigated
The Ideal Individual
· Qualified Solicitor in England & Wales with 2+ years PQE in recoveries or property litigation
· Demonstrable expertise (creditor side) in distressed finance transactions, recoveries, fixed charge receiverships, bankruptcy and related litigation
. Experience advising lenders (regulated or unregulated) is highly advantageous
· Strong commercial acumen and pragmatic approach to legal problem-solving
· Excellent written, verbal, and negotiation skills
· Strong attention to detail and exceptional organisational skills
· Comfortable managing a high caseload independently
· Resilient and capable of thriving in a fast-paced environment
The ideal personality traits for this role would be proactive in their approach, quick to spot opportunities and problems, and ready to tackle them head on. You will thrive in a fast paced and growing environment and will be happy to balance managing strategic tasks with the day-to-day requirements to roll up sleeves to deliver on activity.
Further, you will be a strong mentor to Junior Lawyers and Paralegals within the team and will be expected to work closely with the Head of Legal on broader divisional and business strategy, and to effectively communicate with other business units and external partners to achieve objectives set.
On Offer:
Our client is ideally looking to pay up to c£130k as a basic salary for this role, relevant to experience. Higher offers may be considered for exceptional talent. Salary will be complemented by access to our client's favourable bonus structure also, to enhance annual earnings.
It is also important to note that our client operates a strong and proven promote from within policy which would be very pertinent for this role. Our client has doubled the size of its operation year on year for over half a decade and therefore opportunities to propel salary and career standing forward within may be prevalent, where excellent performance is delivered.
