We are seeking an experienced Court of Protection Solicitor to join our dedicated and expanding team within the Wills, Probate, Tax & Trusts department.
The successful candidate will work closely with the firm’s Panel Deputy to deliver person-centred support to protected parties.
You will provide expertise in cases related to the wellbeing of individuals who lack capacity to manage their property and financial affairs, with a good understanding of health and welfare decisions within this context. You will also provide technical guidance to team members.
You will manage a caseload efficiently, ensuring all matters are handled within deadlines with professionalism.
This is a full-time, permanent role reporting to the Head of Wills, Probate, Tax & Trusts.
Key Responsibilities
* Provide advice and representation in Court of Protection cases, including deputyship applications, statutory wills, property and finance decisions, and trust matters.
* Prepare and review legal documents, court applications, and financial reports.
* Manage cost applications and address matters related to nursing or residential home funding.
* Handle deprivation of liberty and safeguarding issues.
* Ensure compliance with file management procedures.
* Stay updated on legislation and case law relevant to the Court of Protection.
* Maintain a proactive, client-focused approach, with interest in business development and marketing.
* Perform additional tasks as required by the Head of Wills, Probate, Tax & Trusts.
Skills, Knowledge & Expertise
You will:
* Be a qualified Solicitor or Chartered Legal Executive with at least 3 years' experience managing your own Court of Protection caseload.
* Have strong knowledge of the Mental Capacity Act 2005 and related legislation.
* Possess proven experience in managing Court of Protection cases.
* Exhibit excellent analytical, research, and problem-solving skills.
* Communicate complex legal concepts clearly, both verbally and in writing.
* Have strong advocacy skills and court experience.
* Demonstrate professionalism, integrity, and ethical conduct.
* Be able to work independently, prioritize tasks, and meet deadlines.
