We are seeking an experienced and highly skilled TUPE Consultant to join our team on a short-term contract basis. The successful candidate will provide critical guidance and support on complex global Transfer of Undertakings (Protection of Employment) regulations and processes, ensuring compliance and smooth transitions for our international projects. About the Role: This is a key consulting role where you will leverage your deep knowledge of TUPE and its international equivalents to advise on upcoming business transfers and service provision changes. You will work closely with our HR, Legal, and Project Management teams, providing strategic and practical expertise to mitigate risks and ensure fair and compliant employee transfers across various jurisdictions. Key Responsibilities: Global TUPE Expertise: Provide expert advice and guidance on the application of TUPE and equivalent global regulations (e.g., Acquired Rights Directive, local labour laws in various countries) to complex business transfers and service provision changes. Due Diligence: Conduct thorough due diligence on transferring employee populations, analysing employment terms, liabilities, and pension implications in a global context. Compliance Assurance: Ensure full compliance with relevant TUPE and international employment laws, internal policies, and best practices throughout the transfer process. Strategic Planning: Develop and implement detailed transfer plans, including risk assessments, stakeholder engagement strategies, and global employee communication frameworks. Consultation Management: Advise on and support formal consultation processes with employees, employee representatives, and trade unions across different cultural and legal landscapes. Issue Resolution: Identify and resolve complex cross-border employment issues arising from TUPE transfers, working closely with legal counsel and local HR teams. Documentation & Reporting: Assist in preparing essential documentation, ensuring transparency and legal compliance for all transfer-related activities globally. Monitor and report on progress, escalating risks and proposing mitigation plans as appropriate. Stakeholder Engagement: Collaborate effectively with internal stakeholders (HR, Legal, Project Management) and external partners (transferring entities, local legal advisors, trade unions) in a multinational environment. Required Experience & Skills: Proven TUPE Expertise: Significant experience leading end-to-end TUPE transfers, with a strong understanding of both UK TUPE regulations and their application in a global context (e.g., experience with transfers involving multiple international jurisdictions). International Employment Law: Demonstrable knowledge of key principles of international employment law related to business transfers and employee protection. Consulting Experience: Prior experience working as a consultant, providing strategic and practical advice to diverse clients on complex HR and employment law matters. Project Management Skills: Ability to manage competing priorities, maintain exceptional attention to detail, and deliver to tight timelines in a fast-paced environment. Communication & Influence: Excellent communication, negotiation, and interpersonal skills with the ability to build strong relationships and influence stakeholders at all levels, both domestically and internationally. Problem-Solving: Strong analytical and problem-solving abilities, capable of identifying nuanced risks and developing practical, legally sound solutions for global scenarios. Adaptability: Ability to quickly adapt to new environments and understand diverse legal and cultural contexts. Qualifications: Relevant HR or legal qualification highly desirable (e.g., CIPD Level 7, legal degree with employment law specialisation). Contract Details: Duration: 2-4 weeks (flexible based on project scope and needs). Location: Remote/Hybrid (to be discussed, with potential for occasional on-site engagement as required).
