As part of our growth, we are seeking a talented Commercial Claims Manager to lead, manage, and coordinate claims management for our large and complex power plant projects. This role will be part of our Contract Management Function and involves handling claims arising from complex power projects within various contractual relationships, including with customers, consortium or collaborative partners, insurers, subcontractors, and suppliers. The goal is to maximize operational and financial performance while reducing risks.
Roles & Responsibilities
1. Claim Strategies
* Establish project-specific claim strategies in collaboration with Project Managers and ensure their implementation.
* Develop and maintain project/subcontract claim procedures.
* Collaborate with planners/schedulers to optimize project programs for potential claims.
* Lead claim-related risk and opportunity identification, quantification, and mitigation.
* Implement the company's claim management process and tools on projects.
* Increase commercial awareness within project teams via tools, processes, and training.
* Identify and close claim management gaps.
* Establish record creation, storage, and access processes.
* Provide claim management tools and best practices to project teams.
1. Claim Management
* Achieve claim management objectives related to schedule delays, productivity, costs, design issues, and contract interpretations.
* Manage claims in partnership with legal, planning, insurance, tax, finance, and other functions.
* Prepare, negotiate, and settle claims with various stakeholders.
* Establish and execute claim-specific action plans.
* Lead external law firms and consultants in claim preparations as needed.
* Analyze contractual terms, costs, records, and schedule data to support claims.
* Collaborate with schedulers on delay analyses using recognized methodologies.
* Coordinate with financial controllers for cost assessments.
* Prepare reports, correspondences, and develop claims resolution strategies.
* Participate in contract closeout and settlement negotiations.
* Draft and negotiate settlement agreements and change orders.
* Support legal teams in dispute resolution proceedings.
* Prepare early case assessments with external experts if necessary.
2. Reporting
* Maintain claim filing systems and registers.
* Present claims to senior executives for major claims.
* Report claim progress, estimates, and outcomes to leadership.
3. Knowledge Sharing and Training
* Provide training on claims management, procedures, tools, risks, and opportunities.
* Contribute to developing the company's claim management expertise by capturing lessons learned.
Candidate Profile
Candidates should have:
* University degree in Contract Management, Quantity Surveying, Business, or Law.
* Experience in claim and contract management in international or construction projects.
* Knowledge of dispute resolution procedures and methodologies.
* Proven experience with FIDIC contracts.
* Expertise in delay analysis, quantum techniques, and productivity loss calculations.
* Strong track record in claims preparation and settlement.
* Analytical, negotiation, and broad commercial skills.
* Ability to interpret construction contracts, drawings, and specifications.
* Understanding of EPC contracts and contract law principles.
* Leadership and motivational skills.
* Proficiency in MS Office applications.
* Fluency in English.
Desirable qualifications include professional certifications (ICC, IMI, RICS, IDRRMI), project management experience, excellent communication skills, knowledge of nuclear power plants, cultural awareness, Primavera P6 skills, and additional languages such as French.
