Legal and Equality Statements
Under the Rehabilitation of Offenders Act 1974 (as amended in 2013), it is unlawful to discriminate against an ex‑offender on the grounds of a spent conviction and applicants are not asked to disclose convictions which are spent with the exception of those posts exempt from the Act. Having an unspent conviction will not necessarily bar applicants from employment. Bloor Homes ensures that those involved in the recruitment process have been suitably trained to identify and assess the relevance and circumstances of offences and have received appropriate guidance and training in the relevant legislation relating to the employment of ex‑offenders, e.g. the Rehabilitation of Offenders Act 1974 as amended. What is a conviction and when does it become ‘spent’? You will have a conviction if you have pleaded guilty to a criminal offence or if you have been found guilty of an offence. A spent conviction refers to a criminal conviction that lapses after a period of time, resulting in a ‘clean’ record. Once a person's conviction has been spent, it cannot be taken into account in many situations, such as when a person is applying for a job.
