Court of Protection Solicitor (Health & Welfare) Flexible / Hybrid Working Available I’m currently working with a growing and highly regarded firm who are looking to appoint an experienced Court of Protection Solicitor (Health & Welfare) to join their specialist team. This is a fantastic opportunity to join a collaborative and supportive department undertaking genuinely meaningful work, representing vulnerable adults and their families in complex and sensitive matters. The Role You will manage a varied caseload of Health & Welfare Court of Protection matters, including: Capacity and best interests applications Residence, care and contact disputes Section 21A applications under the Mental Capacity Act 2005 Ongoing proceedings within the Court of Protection You’ll work closely with the Official Solicitor, local authorities, medical professionals and care providers, advising on complex issues that have a real impact on clients’ lives. Key Responsibilities Managing your own caseload from instruction through to conclusion Drafting applications, witness statements and court documentation Advising clients, family members and professionals on capacity and best interests Instructing counsel where appropriate Advocacy and attendance at Court of Protection hearings (where suitable) Ensuring compliance with the Mental Capacity Act 2005, Care Act 2014 and relevant case law Supporting and supervising junior team members where appropriate About You Qualified Solicitor in England & Wales Demonstrable experience in Health & Welfare Court of Protection work Strong knowledge of the Mental Capacity Act 2005, Care Act 2014 and associated case law Experience of Civil Legal Aid (desirable) Excellent drafting, communication and advocacy skills Compassionate, client-focused approach with strong attention to detail Able to work independently whilst contributing positively within a team What’s on Offer Competitive salary (dependent on experience) Genuine career progression within a growing team High-quality, interesting and meaningful caseload Flexible and hybrid working Supportive and positive team culture
