Position Summary
Reporting to the Manager, Workplace Investigations, the Sr. Investigation Lead is responsible for conducting impartial, thorough, and timely investigations into complex and sensitive workplace complaints within the organization. These may include, but are not limited to, allegations of workplace violence, workplace harassment, human rights violations, complex Code of Conduct complaints, and complex breaches of the Code of Conduct under applicable legislation, collective agreements, and organizational policies. This role requires an exceptionally organized professional with strong investigative, research, analytical, and information-gathering skills.
The Sr. Investigation Lead plays a critical role in fostering and supporting a safe, respectful, equitable, and healthy workplace culture.
Standard hours are day shifts; however, flexibility is required. Occasional work outside of regular hours including evenings, nights, and weekends may be necessary to meet operational needs.
Key duties and responsibilities:
"Conduct comprehensive investigations into complex and sensitive workplace complaints involving both unionized and non-unionized team members ensuring investigations are timely, thorough, impartial, and procedural fair.
"Develop and execute investigation plans aligned with relevant legislation, collective agreements, case law and organizational policies.
"Conducts Interview with the complainants, respondents, and witnesses using trauma-informed and culturally sensitive approaches to obtain all relevant information and documentation.
"Analyze evidence from multiple sources and utilize an objective credibility assessment to make factual findings and determine whether the established facts constitute a breach of applicable policies, procedures, or legislation.
"Prepare detailed, objective, and comprehensive investigation reports.
"Communicates the results of the investigation to the parties, including preparing and delivering formal findings letters.
"Provide expert guidance and peer review for investigations conducted by other team members.
"Collaborate with legal counsel and represent the organization in legal proceedings as required to testify and give evidence regarding investigations including grievance arbitration.
"Ensure accurate, complete, and secure documentation of all investigative activities in the case management system in a timely manner.
"Support the development and updating of standard Investigation documents, guidelines, checklists and templates.
"Prepare for and participate in legal proceedings and grievance arbitrations.
"Recommend policy, procedure, and program improvements based on systemic findings and emerging trends.
"Support the delivery of training related to investigations, respectful workplace practices, and related organizational policies.
"Identify trends, risks, and systemic issues arising from investigation to support organizational improvement.
"Performs other Workplace Investigations duties as assigned.
Qualifications
"Bachelor's degree in Human Resources, Legal Studies, Business Administration, Human Rights, Criminology, social work, Labor Relations or a related discipline (or an equivalent combination of education and experience).
"Specialized training or certification in Workplace Investigations, trauma-informed practices, and/or equity-informed approaches is preferred.
"Minimum of 5 years' experience conducting complex workplace investigations, preferably in a unionized or public-sector environment and ideally within a healthcare setting.
"Demonstrated ability to apply trauma-informed, culturally competent, and equity-informed lenses to investigations.
"LLB/JD and/or CHRL/CHRP designation is an asset.
"In-depth knowledge of collective agreements, relevant legislation, and case law, including but not limited to Ontario Human Rights Code, Accessibility for Ontarians with Disabilities Act, Occupational Health and Safety Act, Employment Standards Act, Workplace Safety and Insurance Act, Freedom of Information and Protection of Privacy Act.

"Ability to handle sensitive and confidential information with tact and sound judgment.
