We are looking to appoint a Risk & Best Practice lawyer to support the Director of Risk and Best Practice in the delivery of the firm’s risk management and compliance service. We will look to the newest member of the RWKG family to provide commercial and legal support as part of the Risk and Best Practice Team, ensuring the Firm’s risk and compliance controls remain effective and robust and to advise on risk and compliance matters.
Duties will include:
1. To assist with the management of the Firm’s claims and complaints in a timely manner, advising on the merits of both and liaising with relevant internal and external stakeholders, (eg insurers, Legal Ombudsman). Provide regular complaints and claims management information;
2. To assist with the management of the firm’s GDPR compliance, including drafting Data Processing Agreements, managing Subject Access Requests and advising on matters of confidentiality and privilege;
3. To review the Firm’s contracts and retainer terms (eg Engagement Letter precedents, Terms of Business, contracts of insurance, contracts with suppliers and other third parties);
4. To provide legal advice in relation to risk and compliance matters (e.g. money laundering and sanctions, bribery and corruption, FATCA and FCA regulation to the extent it applies to the Firm);
5. To advise on queries arising out of the SRA Standards and Regulations, including the firm’s authorisation and practising requirements;
6. To monitor legal/regulatory developments and manage their implementation within the Firm;
7. To assist with drafting and reviewing the Firm’s policies and procedures to maintain compliance;
8. To promote and encourage professional best practice and innovative business solutions to encourage compliance with regulatory requirements;
9. To assist with enquiries from the SRA or other agencies as required;
10. To assist with the Firm’s Learning and Development programme in the design and delivery of Firm-wide compliance training; assisting with the update of the Team’s intranet page;
Skills, Experience and Attributes
11. An experienced qualified Solicitor or CILEx, either in house or private practice
12. Experience of litigation, data protection and GDPR matters
13. Good working knowledge of the relevant laws, regulations and codes of conduct applicable to the operation of a law firm, including the SRA Handbook
14. Good commercial awareness with a focus on implementing risk and compliance controls within a business
