About The Role
Based in our London and Manchester offices, CMS's Professional Discipline and Regulatory Team has established a strong reputation for excellence in advising healthcare, social care and education sector clients on regulatory compliance. The team is recognised in both Chambers and The Legal 500 for the quality of its work.
Key Responsibilities
Advising on regulatory compliance in all jurisdictions of the UK in the healthcare, social care and education sectors. Advising clients providing education (from early years through to university), social care (children's and adult care homes, fostering, domiciliary care) and healthcare (hospitals, private clinics and remote/online services). Examples of work include registration requirements, funding schemes, Safeguarding, complaints, challenging regulatory body inspection findings, compliance actions (civil and criminal) by regulatory bodies and regulatory cross jurisdictional issues (e.g. global online retailers and international school groups).
Conducting investigations (including professional disciplinary and Safeguarding) to include analysing evidence, interviewing witnesses and drafting statements (including vulnerable individuals), preparing reports and advising on regulatory requirements.
Undertaking due diligence for the acquisition and disposal of health, social care and education organisations and drafting reports on findings. Advising owners, operators and investors.
Inquests and public inquiries - representing clients in high profile cases ranging from multiple unexplained deaths to poor performance and governance systems.
Advising clients on Judicial Review challenges and proceedings in in the First-Tier Tribunal (Care Standards) and Court of Protection.
About You
Essential qualifications/skills/competencies:
Circa 3-5PQE and has good knowledge of the regulatory schemes (in the UK) applicable to healthcare, social care and education (or a selection).
Previous experience dealing with investigations in healthcare, social care and education.
Enthusiasm to learn new disciplines and take on unfamiliar challenges.
Enthusiasm and experience in business development and growing a network (internal and external).
Excellent analytical, drafting, administrative and organisational skills.
Excellent communication skills when dealing with clients/others in meetings, via telephone and email.
Excellent team working skills and an active commitment to knowledge sharing both internally and within the sector by publishing articles.
