The Commercial Director reports directly to the Operations Director (HPC) and is responsible for all commercial and contractual aspects of the HPC contract, including portfolio management, reporting, project controls, payments, and finance.
1. Develop and implement the commercial strategy, aligning with internal legal entities (BUK, BET, BPE, BPT) with clear goals, targets, and objectives.
2. Provide NEC contract expertise, supporting and guiding Bilfinger entities and project teams to ensure effective understanding and use of key contractual terms. Lead senior client meetings to safeguard Bilfinger's interests.
3. Review and analyze monthly project performance reports, validating receivables, WIP, and working capital, ensuring standardization and best practices across contracts.
4. Analyze underperformance across contracts, developing intervention plans to mitigate risks and improve performance, including resolving disallowed costs.
5. Establish a commercial operating culture through standardized reporting, controls, and performance data, ensuring compliance, effectiveness, and transparency.
6. Manage and resolve disputes internally and externally across the contract portfolio promptly.
7. Ensure timely clearance of EWNs and CEs, and conduct reviews in Risk Registers. Define organizational requirements, responsibilities, and oversee recruitment, coaching, and development of the commercial team, ensuring clear communication across entities.
8. Participate in performance reviews, working with teams to minimize withheld amounts monthly.
9. Review and validate rates, margin models, cash-flow forecasts, and tender commercial aspects, ensuring acceptable terms and margins. Support recovery plans for underperforming contracts.
10. Ensure correct application of the AFP process and timely submissions to clients.
11. Provide commercial leadership in tender reviews and contract handovers, supporting the transition from tender to delivery teams.
12. Lead stakeholder management with clients to mitigate losses and develop claim strategies for financial recovery.
13. Collaborate with the Operations Director to develop budgets and forecasts.
14. Identify, discuss, and implement efficiencies and savings on the HPC project.
15. Ensure timely delivery of plans in accordance with the master contract, closing gaps as needed.
16. Manage BTOP initiatives with other Commercial Directors to deliver measurable benefits.
17. Conduct monthly site visits to drive commercial performance, innovations, and lessons learned.
18. Support regional commercial teams during client audits.
19. Travel approximately 2-3 days per month to Bilfinger locations in Hull, Warrington, Germany, and France.
