As part of our further business growth, we are looking for a talented Commercial Claims Manager to lead, manage and coordinate claims management for our large and complex power plant projects pursuing commercial, financial and scheduling targets. This role will form part of our Contract Management Function. The Commercial Claims Manager has responsibility for claims management arising out of the execution of complex power projects within various contractual relationships related thereto including towards the customer, consortium or collaborative partners, insurers, subcontractors and suppliers targeting to maximize operational and financial performance whilst reducing commercial and financial risks. Roles & Responsibilities Claim Strategies Establish project specific claim strategies in collaboration with the Project Managers (Commercial) and ensure adequate actions are taken to implement such Establish and maintain Project/Subcontract - Claim Procedures Collaborate with Planners/Schedulers in optimizing our companys project specific programs for potential claims Lead claim related risk and opportunity identification, quantification and mitigation Commercial Awareness and Tools Implement our companys claim management process and required tools on dedicated projects Actively increase commercial awareness within our project culture via tools, processes and trainings Identify claim management gaps and close them Implement an effective process of record creation, storage and access Provide tools and best practices in claim management to project teams Claim Management Achieve the projects claim management objectives related to schedule delay, productivity, labor and material cost escalation, design issues, and contract interpretations Manage claims in partnership with specialist functions such as legal, planning, insurance, tax, finance, etc. Preparation, negotiation and settlement of claims against customers, consortium partners, insurers, subcontractors and suppliers as well as claim defenses for claims against us Establish and run claim specific action plans Subject to individual claim situations, efficiently lead external law firms and consultants in claim preparations For claims preparation ensure the following requirements are taken into consideration: Analysis of contractual terms and conditions, contract pricing, rates and productivity levels; Inspection of records and contractual notices, actual time spent, costs incurred, actual productivity achieved, escalation costs resulting from increased labor wage rates and bills of quantities, etc; Preparation of a cause and effect detailed analysis and critical path using accepted scheduling techniques; Identification of contractual remedies for the recovery of cost and time; and Compare and analyze base-line schedules against an executed schedule to determine the accuracy of the claim and any delay impact upon the schedule and making recommendation as to the allocation of fault and responsibility of the parties for the additional cost and delay. Collaborate with Planners/Schedulers in preparation of delay analyses pursuant to recognized methodologies Collaborate with financial controllers to substantiated cost assessments for claims Prepare reports, correspondences and present claim analysis, findings and/or opinions and develop claims resolution strategies for use in negotiations with third parties Participate in Contract commercial closeout and settlement negotiation meetings Ensure that regular Project and commercial meetings with the customer, partners and vendors shall be held to review progress of claims and to settle claims Draft and negotiate settlement agreements/change orders Collaborate with and support the legal team in the event of actual or potential arbitral or litigation proceedings related to claims Prepare early case assessments as applicable with external expert support for matters entering dispute resolution proceedings Reporting Ensure that claim filing systems and claim registers are established and maintained Present claims to the Claim Review Boards with company senior executives for any major claim in accordance with company policies Report claim progress, settlement estimates and outcomes to senior leadership Return on Experience and Trainings Provide training to project teams and relevant functions on claims management, procedures and tools and claim risks and opportunities Contribute to the continued development of the companys claim management expertise by capturing return on experience and ensuring implementation of lessons learned Profile Candidates must present the following qualifications to be considered eligible for this position: University Degree in Contract Management, Quantity Surveying Business or Law Demonstrable experience in a claim management/contract management discipline in an international project and/or construction environment Experience with different dispute resolution proceedings and relevant methodologies Proven experience with FIDIC contracts Expert know how relating to delay analysis and quantum techniques and methodologies and in calculating and analyzing productivity losses Good track record of cost, extension of time claims preparation and settlement Strong analytical skills to assess and resolve claims and identify strength and weaknesses Strong negotiation skills Broad commercial knowledge covering multiple disciplines Ability to interpret construction contracts, drawings and specifications Ability to build claim strategies Solid understanding of EPC project contracts and contract law principles Ability to lead, influence and motivate team also without solid reporting line Accomplished computer skills particularly in utilizing the latest MS-Windows, Word, Excel and other Office applications Fluency in written and spoken English Enjoy working in international teams It is desirable for Candidates to present the following additional qualifications for this position: Professional certification with ICC, IMI, RICS or IDRRMI or similar Project Management experience and/or professional registration Excellent written and verbal communication skills to effectively communicate with internal and external stakeholders Knowledge of nuclear power plant characteristics and their project development Open to criticism, able to handle conflicts Cultural awareness and team player Primavera P6 scheduling capabilities Additional French language skills Join us and work with global teams to support global customers !
