The Commercial Director (HPC) reports directly to the Operations Director (HPC) and is responsible for all commercial and contractual aspects of the HPC contract, including managing a portfolio of contracts, reporting, project controls, payments, and finance.
1. Develop and implement the commercial strategy, ensuring alignment with internal legal entities (BUK, BET, BPE, BPT) with clear goals, deliverables, targets, and objectives.
2. Provide NEC acumen and guidance to Bilfinger entities and project teams to ensure effective use of key terms; lead senior client meetings to mitigate exposure.
3. Review, analyze, and challenge monthly project performance reports, validate receivables, WIP, and working capital, and standardize reporting across contracts.
4. Identify underperformance issues, develop intervention plans to mitigate risks, and improve performance, including resolving disallowed costs.
5. Promote a commercial operating culture through standardized reporting, controls, and performance data to ensure compliance, transparency, and effectiveness.
6. Manage disputes internally and externally, ensuring timely resolution.
7. Oversee the clearance of EWNs and CEs, and review risks in the Risk Registers.
8. Define organizational requirements, recruit, coach, and develop the commercial team, ensuring clear communication across entities.
9. Participate in performance reviews, work with teams to mitigate withheld amounts, and review commercial aspects of tenders, including rates, margins, cash flows, and contractual terms.
10. Ensure correct and timely AFP submissions and provide commercial leadership during tender reviews and contract handovers.
11. Lead stakeholder management to mitigate losses and develop claim strategies for financial recovery.
12. Collaborate with the Operations Director to develop budgets and forecasts, and identify efficiencies and savings.
13. Ensure timely delivery of plans, work with entities to close gaps, and manage BTOP initiatives to deliver measurable benefits.
14. Conduct site visits to drive commercial performance, support innovations, and share lessons learned.
15. Assist regional commercial managers with client audits and travel as needed to Bilfinger locations in the UK, Germany, and France.
