We produce exceptional sparkling wine, but always keep in mind that the reference to exceptional goes beyond wine, it extends to every touch point of the brand.As an expert in your field, you will be responsible for a broad scope of responsibilities with a significant emphasis on effective management of legal compliance issues, advisory service and strong relationship management. This role has ownership and accountability for providing professional advice and establishing frameworks in legal, governance, risk and compliance. This position would suit an ambitious and driven individual who has a pragmatic approach and is motivated and dedicated to take ownership and excel in this dynamic position. Nyetimber has its main vineyard and brand home at the Nyetimber Vineyard in West Chiltington, a corporate head office in London, a winery facility in Crawley, two pressing centre facilities in West Sussex and 11+ vineyards across Sussex, Kent and Hampshire. Travel potentially required ad hoc to the Nyetimber Vineyard, winery and/or pressing centre.Main responsibilities & duties:To secure legal compliance and effective management of legal risk across the business.To advise the leadership team on the legal matters of the organisation in relation to business development and performance.Developing and overseeing the systems that ensure that the Company complies with all applicable policies and procedures, in addition to its legal, and statutory requirements and guidance (customs and excise, alcohol licensing, planning, food regulations, health and safety, consumer regulations, ASA rules on advertising, promotions and marketing of alcohol).Establishing and managing procedures for sound corporate governance. Ensuring compliance with all reporting, filing and other documentation requirements.Working closely with the Leadership team and external regulatory and industry bodies (HMRC, Customs & Excise, WineGB, WSTA, DEFRA, Home Office, Natural England) to deal with any legal matters.Working closely with the Head of HR on ad hoc employment matters, such as health and safety, seasonal workers and the Employee Handbook.Monitoring changes in relevant legislations (including data protection, intellectual property, corporate governance and GDPR) and industry regulations (wine laws in the UK and Europe, UK and International advertising standards, packaging and labelling laws, alcohol warehousing) and action accordingly.Act as the first point of contact for both internal employees and external enquirers for legal and compliance matters.Assisting on data protection and privacy legal matters throughout UK, EMEA region and beyond.Managing matters related to intellectual property ownership, protection and assisting in trademark matters (new registrations, territories, product lines), web domain registration and management and leading on all infringement work (external counsel used for day-to-day management of TM registrations).Company acquisition and corporate work, reviewing associated financing arrangements, new business or products lines.Handling, leading on and resolving litigation matters from time to time (with support from external counsel as necessary). Supporting ecommerce platform changes, updating T&Cs, advising on legal elements of consumer journey.Managing set up in new territories as and when required.Creating and maintaining legal frameworks for all contract preparation, negotiation on terms and conditions to manage the legal risks across the business.Establishing a robust contractual framework for all contract documentation across the organisation. The legal frameworks should allow internal departments to manage the majority of their contracts independently.Working closely with the CEO, Managing Director and key stakeholders to review all legal documents for land, building or company acquisitions, as well as construction projects, including liaison with lawyers and land agents, reviewing, preparing and writing valuation agreements, negotiation terms and offers.Responsible for legal matters related to land (including vineyard) and buildings lease management, including reviewing and drafting legal documents in relation to negotiating new leases and end of leases dilapidations, farm business tenancies & grazing licences.Qualifications and Experience:Essential:An ambitious and dedicated, qualified solicitor, with extensive experience who holds a current practising certificate for England Wales.
