Court of Protection Solicitor – Health & Welfare
Are you an experienced Court of Protection Solicitor with a passion for health and welfare law? An exciting opportunity has arisen to join a highly respected, nationally recognised Court of Protection team, currently listed as a ‘Firm to Watch’ in The Legal 500. This is a rare chance to work alongside nationally appointed experts and develop your career in one of the most specialised areas of mental capacity law.
This expanding Court of Protection team includes a Panel Deputy and an Accredited Legal Representative and is known for its commitment to protecting the rights and interests of vulnerable individuals. Due to increased caseload and continued growth, they are seeking a motivated and experienced solicitor to handle complex health and welfare matters under the Mental Capacity Act 2005.
Whether you’re seeking your next career step or are an experienced practitioner ready to lead, this position offers real potential for growth, including the opportunity to manage the team for the right senior-level candidate.
Key Responsibilities:
* Manage a caseload of health and welfare Court of Protection matters, including s.21A and s.16 applications.
* Attend clients, take instructions, prepare cases, and conduct legal research.
* Ensure compliance with file management and regulatory requirements.
* Draft applications, statements, and court documentation, and where appropriate, conduct advocacy.
* Support the Head of Department and collaborate on strategic planning and service development.
* Engage in business development and build professional relationships to drive growth.
* Work empathetically with clients and their families, often in sensitive and challenging situations.
* Maintain accurate time recording and billing processes.
* Proactively implement feedback from file reviews.
Requirements:
* Qualified Solicitor in England & Wales with a current, clean practising certificate.
* Proven experience in Court of Protection health and welfare cases.
* Sound understanding of Mental Capacity Act 2005 and related case law.
* Public and/or privately funded case experience essential.
* Advocacy experience is advantageous but not essential.
* Excellent written and verbal communication skills.
* Ability to manage a varied and complex caseload with minimal supervision.
* Strong organisational, time management, and analytical skills.
* Professional and empathetic approach to working with vulnerable individuals.
* Experience or interest in business development and marketing is desirable.
